1. Scope
This policy applies to everyone using Breakcold, including workspace members, developers and people acting on a customer’s behalf. It forms part of the services agreement. Use the service only for lawful activities within the permissions of your account and plan.
2. Unlawful or harmful conduct
- Do not commit fraud, impersonate others, mislead recipients about your identity or conceal the origin of a communication.
- Do not use Breakcold to threaten, harass, discriminate unlawfully, exploit children, distribute unlawful sexual content or promote violence.
- Do not upload or distribute malware, phishing links, stolen credentials or content that infringes privacy, confidentiality or intellectual property rights.
- Do not evade applicable sanctions, court orders or legal restrictions.
3. Email, social outreach and recording
You are responsible for the legal basis for your contact lists and communications. Comply with the GDPR, applicable electronic marketing rules and the rules of the channels you use. In France, B2B prospecting may in some circumstances rely on legitimate interests when the message relates to the recipient’s professional role and the required information and simple objection mechanism are provided. This is not a general permission to contact every address or to ignore consent requirements.
- Identify the sender accurately and provide an effective way to object or unsubscribe where required.
- Honor objections, opt-outs and suppression lists promptly. Do not re-import an opted-out person to evade their choice.
- Do not send spam, use unlawfully obtained contact lists or bypass a provider’s sending, account or anti-abuse restrictions.
- Inform participants and obtain any required permission before recording or transcribing calls or meetings.
4. Personal data and account access
Access only accounts and data that you are authorized to use. A public social profile, business email address or other professional record can still contain personal data. Public availability does not remove your obligations to inform people, use a lawful basis, minimize data and respect their rights.
Do not upload special categories of personal data, criminal conviction or offence data, or other highly sensitive data that the service is not designed to handle, unless we have expressly agreed suitable terms and safeguards in writing. Do not use the service to trade personal data unlawfully or expose another workspace’s information.
5. Protecting the service
- Do not bypass authentication, workspace permissions, usage limits or security controls.
- Do not access another customer’s data, share credentials with unauthorized people or publish secret API keys.
- Do not conduct denial-of-service attacks, destructive tests, intrusive scanning or activity that materially overloads our systems.
- Do not scrape protected application data or use undocumented access methods to evade controls. Permitted APIs, documented integrations and lawful use of public material remain subject to their applicable terms.
Report suspected vulnerabilities through our vulnerability disclosure policy. Obtain specific written authorization from Logike before security testing. This policy does not authorize tests of third-party systems.
6. AI and automation
Review AI outputs and configure automations with appropriate human oversight. Do not generate deceptive impersonations, unlawful discriminatory profiles or harmful content. Do not use Breakcold for prohibited AI practices or for automated decisions producing legal or similarly significant effects without satisfying applicable law.
Do not submit data to an AI feature unless you have the right to process it for that purpose. Connecting an account does not authorize every possible use of its data. Respect the permissions, restrictions and notices that apply to each integration.
7. Reports and enforcement
Report suspected abuse to support@breakcold.com, with enough detail to identify the activity. Do not send passwords or unnecessary personal data.
We may investigate a report and restrict the affected content, account, integration or feature when reasonably necessary to protect people or the service, comply with law or address a material violation. Where practical and lawful, we explain the reason and give you an opportunity to respond or correct it. Contact support if you believe a restriction was mistaken. Suspension, termination and any related payment rights remain governed by the services agreement and mandatory law.
